These Terms of Use (“Terms”) are an agreement between you and myhtml, operated by Vertial Holdings Pty Ltd(ABN 72 629 494 926) (“we”, “us”), of New South Wales, Australia. They govern your use of myhtml.io, the sites we host at *.myhtml.site, and our API, CLI, and MCP server (the “Service”). By using the Service you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.
1. Who can use myhtml
You must be at least 16 and able to form a binding contract. If you use the Service for an organisation, you confirm you may bind it to these Terms.
2. Your account
You sign in with a magic link sent to your email. You’re responsible for your account, your API keys, and everything done through them. Keep your keys secret and tell us promptly at hello@myhtml.io if you suspect unauthorised use.
3. The Service
myhtml hosts the HTML you deploy and gives your pages a zero-config backend (database, files, and — when enabled — AI and realtime). Some features are in beta and may change or be withdrawn. We may modify, suspend, or discontinue parts of the Service, and will give reasonable notice of material changes where we can.
4. Acceptable use
You agree not to use the Service (or let anyone use your sites) to:
- break the law or infringe anyone’s rights;
- host phishing, scams, fraud, or pages that impersonate others to harvest credentials or payment details;
- distribute malware, crypto-drainers, exploit kits, or code that attacks or deceives visitors;
- publish child sexual abuse material, non-consensual intimate imagery, or content that is unlawfully hateful, harassing, or that incites violence;
- infringe copyright, trademarks, or other intellectual-property or privacy rights;
- send spam, or use the Service for unsolicited bulk messaging;
- mine cryptocurrency, run botnets, or use the backend for sustained abusive load;
- attempt to break isolation, exceed or evade rate limits and plan quotas, access other users’ data, or probe the Service for vulnerabilities without authorisation;
- resell or wholesale the Service as your own hosting product without our agreement.

5. Your content
You keep all rights to what you deploy (“Your Content”). You grant us a worldwide, non-exclusive licence to host, store, scan, reproduce, and serve Your Content solely to operate, secure, and improve the Service. You are responsible for Your Content and confirm you have the rights to use it and that it complies with these Terms.
6. Moderation, suspension & takedown
To keep the platform safe, we automatically scan deploys and may review, throttle, withhold (free sites publish via a “slow lane” after a scan), remove, or disable any site or account that we reasonably believe breaches these Terms — sometimes without prior notice where there is risk of harm. Every free site carries a report link, and you can report abuse to hello@myhtml.io. If you believe content infringes your IP, send a notice with the details to the same address and we will act on valid complaints.
7. Plans, billing & refunds
Free and paid plans are described on our pricing page. When paid plans launch, they (and any AI credit packs) will be billed through Stripe; subscriptions will renew automatically until cancelled, and you'll be able to cancel anytime and keep access until the end of the paid period. Fees are stated in the currency shown and may be exclusive of GST or other taxes, which we add where required. Except where the law (including the Australian Consumer Law) requires otherwise, fees are non-refundable. Quotas, rate limits, and AI metering apply as described in the Service.
8. Intellectual property
The Service itself — our software, the mhSDK, our branding, and docs — belongs to us or our licensors. These Terms don’t give you rights to our marks. Open-source components remain under their own licences.
9. Disclaimers
The Service is provided “as is” and “as available”. To the extent permitted by law, we exclude all warranties and do not guarantee the Service will be uninterrupted, error-free, or that hosted sites or stored data will always be available or preserved. You are responsible for keeping your own backups of anything important.
10. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or other law that cannot be excluded. Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited (at our option) to re-supplying the service or paying the cost of having it re-supplied.
11. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, or consequential loss, or loss of profits, data, or goodwill. Our total liability arising out of or relating to the Service is limited to the greater of the fees you paid us in the 12 months before the claim, or A$100. Nothing in this clause limits rights that cannot be limited under clause 10.
12. Indemnity
You agree to indemnify us against claims, losses, and costs arising from Your Content, your sites, or your breach of these Terms or the law, to the extent caused by you.
13. Termination
You can stop using the Service and delete your account anytime. We may suspend or terminate your access for breach of these Terms or to comply with the law. On termination, your right to use the Service ends and we may delete your sites and data (subject to the retention described in our Privacy Policy).
14. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts.
15. Changes to these Terms
We may update these Terms from time to time. We’ll post the new version here and update the date above; for material changes we’ll give reasonable notice. Continuing to use the Service after changes take effect means you accept them.
